SANTA CLARA UNIVERSITY OSHER LIFELONG LEARNING INSTITUTEINFORMED CONSENT, ACCEPTANCE OF RISK AND RELEASE OF LIABILITY
I hereby acknowledge that I have voluntarily decided to participate as a member of a Special Interest Group of the Osher Lifelong Learning Institute at Santa Clara University (“SCU”).
INFORMED CONSENT: I have been informed, and am confident that I understand, the various aspects of participation as a member of a Special Interest Group including but not limited to, as appropriate, the arrangements for travel and logistics. I further understand and acknowledge that despite careful planning and supervision, serious injuries might occur as a participant in a Group. Persons involved may sustain fatal or serious injury, property damage, or severe social and/or economic loss as a consequence of not only their own actions, inactions, or negligence, but the actions, inactions, or negligence of others, weather conditions, and conditions of equipment. There may also be other risks not known to me or not foreseeable at this time.
TRANSPORTATION: It is my understanding that SCU does not make travel arrangements as part of Special Interest Group activities. I, therefore, understand that I accept full responsibility for travel arrangements and the associated costs. Further, SCU is not responsible for any bodily injury or property damage that may arise out of these travel arrangements. I will defend, indemnify, and hold SCU harmless from any bodily injury, property damage, or other incident which may arise out of my travel arrangements.
ACCEPTANCE OF RISK AND RELEASE OF LIABILITY: I accept full responsibility for the foregoing risk of injury, permanent disability or death. In consideration of the opportunity to participate as a member of a Special Interest Group, I release and discharge Santa Clara University, its Trustees, officers, employees, and agents (hereinafter collectively referred to as “University”) from all liability arising out of or in connection with my participation in a Special Interest Group. For the purpose of this Release, liability means all claims, demands, causes of action, suits or judgments of any kind (including court costs and attorney’s fees) that I, my heirs, executors, administrators, assignees, or any other person or entity may have against the University because of my death, personal injury, illness, or for loss arising out of the sole negligence or willful misconduct of the University. I hereby agree that this Agreement shall be constructed in accordance with the laws of the State of California.
INDEMNIFICATION: I agree not to sue the University and hold harmless, defend, and indemnify the University from any and all liability as described above that may occur due to my participation as a member of a Special Interest Group.
MEDICAL INFORMATION: I understand that I should maintain and carry accident medical coverage in the event I am injured or taken ill during the above named activity. If I do not maintain and carry such medical insurance, then any costs or bills whatsoever associated with injury or illness contracted during this activity will be paid for by me or by my legal guardians, heirs or assigns by whatever manner I/they may choose. Santa Clara University is not responsible for paying my medical bills.
PHOTOGRAPHIC/VIDEO: On occasion, the Osher Lifelong Learning Institute (OLLI) obtains, from its members, or from travel participants, photographic or video images of members and event activities. By participating in this program, you authorize OLLI at Santa Clara University, without providing compensation to you, or obtaining additional approvals from you, to include photographic and video recordings of you, as well as voice recordings included with any videos, in OLLI sales, marketing, advertising publicity and/or event activities."
STUDENT CODE OF CONDUCT: Classroom Decorum: Participants in OLLI@SCU are subject to the Student Code of conduct,established by Santa Clara University. Currently, the Student Code is only published in the Student Handbook. https://www.scu.edu/osl/publications/. The Student Code: Applies to the OLLI organization and is designed to promote and protect an environment which encourages reasoned discourse, intellectual honesty, openness to constructive change and respect for the right of all individuals.In keeping with our mission, OLLI seeks to meet the needs of an engaged learning community. If, in the opinion of the OLLI staff, a member or guest interferes with the goals of our learning community, or creates a safety concern, he or she will be asked to leave the class or activity and ultimately may forfeit his or her affiliation with OLLI. Examples of violations may include: threatening behavior; disruptive classroom conduct; sexual harassment; monopolizing discussions; undermining the instructor’s credibility; conversing with others during instruction; cellphone and other electronic device use that is disruptive; poor hygiene and introduction of allergens (ex: perfumes, scents, lotions and/or strong food smells that interfere with the learning experience).The overall goal is to maximize the learning experience for ALL students. Quiet in the Classroom and Halls: We encourage our members to socialize, but please be quiet during class time and in the halls when class is in session.Cellphones and other Electronic Devices: Remember to turn them off or to vibrate mode when you are in class so as not to be disruptive. Smoking: Santa Clara University is a smoke free campus.
BY COMPLETING MY MEMBERSHIP PAYMENT, I AM INDICATING THAT I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS, AND JOIN VOLUNTARILY WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND ACCEPT IT OF MY OWN FREE WILL. I ALSO VERIFY THAT I AM OF LEGAL AGE AND ABLE TO ACCEPT THIS RELEASE ON MY OWN BEHALF.
